A comprehensive analysis of the data protection framework in India. A key focus on privacy, security and trust in the ICT sector.
The Information Technology Industry Council (ITI) commends the initiative of the Government of India (GOI) and the Ministry of Electronics and Information Technology (MEITY) in crafting a comprehensive white paper on data protection for India. The ITI, representing the world’s top tech companies, aims to be a resource in the development of robust, globally interoperable data protection policies.
As privacy, security, and trust are vital to our companies’ continued success, we are committed to the responsible use and protection of personal information. With our global perspective and broad expertise, we urge governments to develop privacy frameworks that encourage responsible use of personal information, promote domestic innovation, and facilitate free data flow.
The ITI’s membership includes global firms from various corners of the ICT sector, each of which has vast practical experience with the privacy and data protection frameworks of nearly every country. This broad perspective and expertise inform our recommendations and approach towards creating sustainable data protection policies.
Each country presents a unique set of challenges and opportunities in developing data protection policies. It is important to strike a balance between respecting privacy rights and promoting technological innovation and economic growth. The ITI welcomes the recent ruling of the Supreme Court of India that privacy is intrinsic to life and liberty.
The formation of the Expert Committee on Data Protection under Justice B. N. Srikrishna by India’s MEITY signals a new stage in India’s advancement on the world stage. As part of implementing data protection policies, we offer the following recommendations to GOI’s White Paper consultation questions.
As part of demonstrating our commitment to privacy, we adhere to the principles of notice, consent, choice, purpose, security, and more in handling personal data. These principles, often encoded into our companies’ practices, serve as an example of how to operationalize data protection.
Our members operate in various countries, each with its unique data protection regulations. This diversity provides us with a rich array of experiences and insights which we can utilize to improve our own practices and contribute to the discourse on data protection.
In our companies, data protection is not an afterthought but is embedded in the design and architecture of our systems. Privacy, security, and trust are central to our operations, and we take our obligation to protect personal data very seriously.
When issues arise, our companies have mechanisms in place to address them promptly. We continually monitor and improve our practices to ensure the safety and privacy of personal data.
